Overview of FSSAI Annual Return
With the aim to regulate and prevent the food industry, the Government of India has introduced the Food Safety and Standards Act, 2006. The Food Safety and Standard Act, 2006, provides laws that help and direct the Food Business Operators about the sale, manufacturing, distribution, storage and import of food products within the country. Getting FSSAI license is essential for all the food business owners or operators. Displaying the FSSAI license within the working place or premises and printing the license number on the pack of the food product is also a mandatory thing for FBOs to do. And importantly, It is also mandatory for food business operators having FSSAI license to file FSSAI Annual Return regularly.

Filing the FSSAI Annual Return
- Business related to food manufacturing, exporting, importing, selling are needed to file for the FSSAI annual return regularly.
- Business operators who are involved in the manufacturing and distribution of milk products should file FSSAI annual return for every half-yearly.
- Each Food Business Operators with the annual turnover exceeding Rs.12 lakh should file FASSI Annual Return.
How to file FSSAI Annual Return?
Food Business operator can file for FSSAI annual return depending on their convenience. The FSSAI annual return form is there in two forms; the food business operator can fill it either physically or electronically as the form is available in both as well.
- The name of the Food product which is being manufactured, imported, exported or handled.
- The size of the pack or bottle or can or any other package details
- Quantity in a metric ton
- Value of the food product
- Quantity or measurements in kgs in which the food product are being exported or imported
- The selling price of the food products (per unit or per kg)
- The list of the countries in which food products or food items are exported
Mandatory FSSAI Annual Return
It is mandatory for all type of food business operators to file for FSSAI Annual Return. There are two kinds of annual return forms available and they are:
FSSAI Form D1
Food business involved in importing, labeling, distributing, manufacturing, re-labeling, packing, and re-packing needs to register for FSSAI Form D1, completing and submitting form D1 is mandatory for them. This form is officially issued by the Food Safety Commissioner and it is mandatory for all the Food Business Operators regardless of the product they are involved in. The FSSAI annual return, Form D1 should be submitted on or before 31st May of every year. The Form D1 is submitted with the Licensing Authority according to the type of food items or food products traded or sold by the Food Business Operators in the next financial year.
- Due Dates : 31st May of every year
- To Be Filed By : Every food operator, manufacturer, importer etc.
FSSAI Form D2
Form D2 is filled between 1st April to 30th September and between 1st of October to 31st of March of every year.
- Due Dates : 30th September/30th March
- To Be Filed By : Manufacturer of milk or milk products or dairy products
Penalty for filing of FSSAI Annual Return beyond the due date
As per Section 2.1.13 (3) of FSS rules and Regulations, 2011, if the food business operators don’t record the annual return of the business within the specified time period, a penalty or a fine of Rs 100 will be pushed on them systematically and will continue increasing if the default proceeds.
